1. Acceptance of Terms

By accessing or using the AtwalLabs platform at atwallabs.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and AtwalLabs ("we," "our," or "us").

2. Description of Service

AtwalLabs is a rule-based test automation platform that enables users to write test cases in plain English, translate them into executable browser automation actions, and run them against web applications. The Service includes test case management, test execution, video recording, report generation, knowledge base learning, and related features.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• You must be at least 18 years old to use the Service.
• One person may not maintain more than one account.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

• Use the Service to test applications you do not own or have authorization to test
• Attempt to access, test, or interact with systems without proper authorization
• Use the Service for any form of denial-of-service attack or load testing without consent
• Upload malicious code, viruses, or harmful content
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Share your account credentials with unauthorized parties
• Use the Service to collect or harvest personal data without consent
• Violate any applicable laws, regulations, or third-party rights

5. Your Content and Data

You retain all rights to the test cases, test data, and other content you upload to the Service ("Your Content"). By using the Service, you grant us a limited license to store, process, and display Your Content solely for the purpose of providing the Service.

• You are responsible for ensuring Your Content does not violate any laws or third-party rights.
• You are responsible for the accuracy and legality of any test data you upload.
• We do not claim ownership of Your Content.
• We will not access, review, or share Your Content except as necessary to provide the Service or as required by law.

6. Automated Test Generation

The Service translates plain-English test steps into executable browser actions using a deterministic rule-based engine. Element location uses a deterministic resolution chain. No machine-learning model decides what the Service clicks or types.

• Locating elements using learned, inspectable locator data
• Recording each step’s outcome, screenshots and captured values

Generated test cases may not match your intent, and a passing run is not a guarantee of correctness. You are responsible for reviewing generated test cases before execution and for validating their results. An optional hosted translation service may be enabled for your deployment; it is off by default, and when on it receives your step text as written.

7. Test Execution

When you execute tests through the Service:

• Tests are executed against target web applications using automated browser instances.
• You are solely responsible for ensuring you have authorization to test the target applications.
• Screenshots, video recordings, and reports generated during execution are stored in your account.
• We are not responsible for any consequences resulting from test execution against unauthorized targets.
• Test execution may interact with third-party websites. You must comply with those websites' terms of service.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned maintenance.

9. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is owned by AtwalLabs and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written consent.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind.
• We do not warrant that the Service will meet your requirements or be error-free.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not liable for damages resulting from test execution against third-party applications.

11. Indemnification

You agree to indemnify and hold harmless AtwalLabs from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time for:

• Violation of these Terms
• Unauthorized testing of third-party applications
• Abusive or harmful behavior
• Non-payment (if applicable)

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Los Angeles County, California.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
